Terms & Conditions

Last Modified - 02/02/2010

ArmaHost ("We" or "Us" in this document) would like to keep things running smooth, offering you the best possible service we can. We would like you to feel free to have fun and learn a lot when purchasing a server or other service from us. However, there are certain things you cannot do of which are highlighted in this Terms & Conditions document.
For our service to be a great experience for everyone we have to outline a few rules (although its more fancy if we call them 'Terms', even if it does sound a little too serious). We don't feel that there are too many and that you shouldn't have a problem agreeing to them.
All purchases made within this agreement will require you to agree to these Terms & Conditions.

1. Code of Conduct

We will not tolerate any abuse from customers or those affiliated to them. We understand that you may become frustrated if something doesn't work; however being abusive to us will not make us work quicker.
You will be warned about your behavior by a member of staff. If you still continue to be abusive we reserve the right to cancel your contract and service without a refund.

2. Contract

For every purchase made with a service we offer, you are automatically placed into a contract with us after the payment is cleared. This contract lasts the period of your service and will expire at the end (unless a payment is again received for the renewal of the service).
We reserve the right to cancel a contract and service if there is any breach of any law or of our Terms and Conditions.

2.1 Service Cost

If we have a special price or deduction offer that does not specifically say its duration, it can be assumed that the price is permenent as long as you keep a continous contract with us.
We will not change the cost of our service (with or without any deductions) unless we receive an unforscene change in the costs of the services we use. This is out of our control and we reserve the right to increase the price in this situation to ensure your service will remain online. You will be notified before these changes are made.

3. Payment of Service

We currently use PayPal as our payment gateway. We will only start your contract once PayPal confirms that your payment has cleared successfully. Any payments sent but not cleared will not be setup, as it is very common for hackers and fruadsters to use a payment that will bounce; allowing them access to the service for a short period of time.

4. Acceptable Use Policy

This section of the Terms & Conditions outlines what you can (or more specifically what you can't ) do with your server. We would love it if you had the freedom to do what you want, however some people will abuse that; making the service for other customers below the standards they expect.

4.1 Data Storage

We offer our customers the ability to upload MP Missions and addons using an FTP client. This is for .pbo and the sign/key files for these only. You are forbidden to upload any other file type (although a .txt file to keep notes is allowed) to these folders. Any forbidden files found will result in a review of your account and contract status.

4.2 Server Regulations

Although the server is yours, of which you can name and promote it to how you wish; we must ensure that the server is not used to promote illegal activity.
Your server, and those who play on it (who of which are your responsibility while playing on the server) must not:
* Promote cyber crime or extreme illegal activity such as pirated media (software, music and videos etc). This also includes the promotion and display of pornography.
* Use the service to damage the reputation of ArmAHost, it's customers, stakeholders or other affiliates.
* Use the service to purposely disrupt the network or servers of ArmAHost.

4.3 Prohibited Access

You must not attempt to access files, folders or data that you are not prohibited to see or use. Any attempt to modify or access these files to gain a personal advantage can be considered as fraud and may result in legal action depending on the circumstances. It is not possible for you to easily modify a prohibited file without purposly doing so.

5. Downgrade or Downtime of Your Service

We will do our very best to ensure your service remains online and pleasent to use. However, there may be required scheduled downtime or maintenance at some point. We reserve the right to provide you with at least 24 hours notice of scheduled downtime, of which will be posted in your Control Panel as soon as possible.
If there is any unplanned downtime of your service we will try and restore it as soon as possible. Depending on the nature of the downtime and its duration, it can depend if there will be any refund or discount on your next contract. The final decision of a refund or deducation will made by us of which depends on the circumstances of the downtime.

5.1 Backups

We do not backup any user content that you upload or store on our servers. If you accidently delete one of the original server files (eg an addon .pbo file) we will be able to restore it for you. We will not be responsible for the downtime you may have due to this error.

6 Terms & Conditions Update

We reserve the right to update our Terms and Conditions (this page) without warning. It is the users responsability to check the Terms and Conditions.
